Practicing EU law by Competing against Universities from all over the World

The European Law Moot Court competition is one the big prestigious international Moot Courts, in which universities from all over the world compete against each other. Every September the new Moot Court case is published. Amongst the teams that have submitted written pleadings, the best 48 will be selected for an oral hearing, which takes place in one of four possible regional finals all over Europe (sometimes also in the US). The winners of these regional finals compete against each other in Luxemburg at the European Court of Justice in front of the real ECJ judges.

Dr René Repasi acts as a judge in this competition since 2011. He also drafted already twice the case for the ELMC. Being a judge at the most renowned EU law competition is a special honour for an EU law academic. The ELMC Society appoints every year 20 judges worldwide for the four regional finals, who come from academia, legal practice and the EU institutions.

This year Dr Repasi was appointed as a judge at the regional final, which was hosted by the University of Ljubljana in Slovenia. This year’s case revolved around challenges of the EU rule of law with a fictive Member State that tries to prevent a lower court to refer preliminary questions to the ECJ and that rejects the execution of a European arrest warrant against a politician from another Member State that got persecuted by this Member State for having committed the crime of hate speech and racism.

‘I was very much impressed’, said Dr Repasi, ‘by the performance of the students, by their huge motivation to plead challenging questions of EU law and by their incredible skills and knowledge to deal with the difficult questions that we as judges asked’.
