As a first time participant, the team of Erasmus School of Law managed to qualify for the final rounds of the 2021 Ian Fletcher International Insolvency Moot.
The 2021 Fletcher Moot team consisted of four students of Erasmus School of Law, who are enrolled in the master's programme Commercial Law; Marie-Sophie Melcher, Ulf Schwartz, Else-Marie van den Herik, and Sicco Wassink. Their coach was Warren de Waegh, PhD researcher at the School.
The moot case revolved around a cross-border insolvency administered on the basis of the UNCITRAL Model Law on Cross-Border Insolvency before the Supreme Court of the fictional state of Nuzilia. In the first round, the student teams were assessed on their written submissions, including memoranda for both claimant and respondent. Based on this assessment, the top 12 teams proceeded to the final rounds, there the top teams will directly plead against each other, alternatively representing both claimant and respondent. This year, the team of Erasmus School of Law qualified for the final rounds as one of the top 12 teams in the written round out of 33 participating universities. The pleadings were all held online. In the end, the team of Erasmus School of Law team fell slightly short against the West Bengal University of Juridical Sciences, who became the grand finalists in the competition.
