Democracy as a core European value

On Friday 8 November 2024, President of the European Court of Justice Koen Lenaerts delivered a thought-provoking speech on democracy as a core European value. Lenaerts spoke during an interactive symposium in front of young academics of Erasmus School of Law. 

In his lecture, titled: “The Peoples of Europe and the Court of Justice: Upholding Democratic Values”, Lenaerts reflected on Article 2 of the Treaty on European Union, and discussed democracy as one of twelve foundational values, including human dignity, freedom, equality, and rule of law. These values, he emphasised, are interdependent, collectively defining the EU's identity as a "common legal order" rather than a traditional state. 

Lenaerts argued that the EU’s democratic integrity relies on all member states upholding democratic standards domestically. A democratic deficit in any member state, he cautioned, risks weakening the EU's democratic structure, given the Union’s reliance on member states’ input through representative governance at the national level. He highlighted recent challenges within the EU, where democratic backsliding in certain countries has threatened collective governance and values. 

Emphasising transparency, openness, and media pluralism as essential for accountable governance, Lenaerts underscored the importance of informed citizens in a functioning democracy. His reflections also touched on the complex dynamics of freedom of the press, judicial independence, and the need for mutual trust among member states. Ultimately, he urged the present young scholars of Erasmus School of Law to continue exploring the evolving concept of democracy in the EU, as both a legal and philosophical construct intertwined with human rights and rule of law.

Koen Lenaerts to receive honorary doctorate

Following the recommendation of Erasmus School of Law, judge Lenaerts, will receive an honorary doctorate by Erasmus University Rotterdam. The title “Doctor Honoris Causa” is to be bestowed upon him during the celebration of the University’s 111th anniversary. Fabian Amtenbrink, Professor of European Union Law at Erasmus School of Law, act as his honorary promotor.
