Trust is often described as 'a leap of faith. When things are uncertain we need trust to go on, we can decide to take the leap of faith even if we do not know for sure that things will go well. The trust process is based on the anticipation of the future behaviour of the other actor. Trust is useful because it provides open communication and flexibility, making it easier to collaborate and to resolve conflicts.
What then is the role of trust in regulation?
The literature shows that regulatees are more inclined to follow prescriptions when regulators are reliable. The trustworthiness of the regulator is based on procedural justice, expertise, awareness and responsiveness. Several authors address two types of trust: trust in institutions and trust in people. This shows that the inspector as a person can be important too.
Being trustworthy as a regulator leads to regulatees that provide more information. It contributes to the intrinsic motivation of the regulatees to deliver good care and make quality transparent. It increases the impact of regulation and thus has a positive effect on quality of care
The research shows firstly that the Inspectorate has to find a balance between normative and narrative frameworks for good healthcare (enforcement and control versus dialogue and appreciative supervision). Secondly, the Inspectorate could find ways to link procedural justice and legitimacy of regulation with behaviour and skills of inspectors. Thirdly, the Inspectorate could better balance appreciative and critical inspection. Fourthly, the Inspectorate could use qualitative forms of research and discuss their findings in order to come to a justified interpretation (comparable with member-check in qualitative research)
